[LookOutSugarLake] Kokanee Lodge reacts

Hello all,

As you know, NORD resolved last January that they will not issue 
campground permits for Kokanee Lodge until the developer holds a public 
meeting to discuss his sewage facilities.

Well, the developer has sent his lawyers after those campground permits, 
and much more. Details are before the courts, so we can't have them.

And now the latest submission to the Environmental Appeal Board has been 
received from Kokanee's lawyers, Nixon Wenger (Steve Dvorak). It was 
issued Tuesday night and is on the web at:

The appeal was launched, by us and by the Splatsin FN Band, to stop the 
developer's discharge to water, based on how foul it will certainly be 
at times, and on new evidence of dangerous chemicals to be found in all 
sewage.

You're probably not aware that the schedule for written submissions 
about jurisdiction has been delayed 1 week as requested by the 
developer's lawyers. The submissions are a civilized squabble about 
whether the EAB is even allowed by BC law to hear the appeal. As long as 
NORD doesn't cave in because of the law suit, a bit of delay will not 
put the Shuswap River in any more danger than it's already in, so we agreed.

Our, and the Splatsin Band's, final submissions responding to the 
opposition's submissions have to be in by July 3, next Tuesday. So we'll 
remind you at that time to look at the site for the latest. A decision 
by the EAB as to whether it has jurisdiction to hear will come "in due 
course" some time after that.
